These Terms of Service (“Terms”) govern your access to and use of the LØFTE DESIGNS website and your purchase of products from us.
By accessing our website or placing an order with LØFTE DESIGNS, you agree to these Terms together with the policies referenced within them, including our Privacy Policy, Returns & Exchanges Policy, Shipping & Delivery Policy and Limited Lifetime Manufacturing Warranty.
Please read these Terms carefully before placing an order.
Nothing in these Terms is intended to exclude, restrict or modify any consumer right or remedy that cannot lawfully be excluded, restricted or modified.
1. Website Use
You may use the LØFTE DESIGNS website only for lawful purposes and in accordance with these Terms.
By using our website, you agree not to:

Use the website for any unlawful, fraudulent or unauthorised purpose.

Attempt to interfere with the operation, security or functionality of the website.

Introduce malicious code, viruses or other harmful material.

Attempt to gain unauthorised access to our systems, accounts or customer information.

Reproduce or commercially exploit our website content without permission.

Provide false, misleading or fraudulent information when placing an order.
We reserve the right to restrict access, refuse service or cancel an order where we reasonably believe fraudulent, unlawful or abusive activity has occurred, subject to applicable law.
2. Products
We take reasonable care to describe and present LØFTE jewellery as accurately as possible.
Fine jewellery is inherently affected by materials, craftsmanship and light. The appearance of diamonds and polished gold may vary depending on lighting conditions, photography, screen settings and the device on which images are viewed.
Made-to-order jewellery may also exhibit minor variations resulting from the jewellery-making process. Such minor variations do not necessarily constitute a product defect.
Product specifications, including diamond carat weight, colour, clarity, metal, ring size and certification where applicable, are stated on the relevant product page.
Nothing in this section limits your rights where a product is materially different from its description or otherwise fails to comply with applicable consumer law.
3. Lab-Grown Diamonds
LØFTE DESIGNS jewellery is created using lab-grown diamonds.
Lab-grown diamonds have the same fundamental chemical composition and crystal structure as mined diamonds and exhibit the same optical properties.
Diamond specifications vary by product and are stated on the applicable product page.
Qualifying diamonds over 1 carat are accompanied by an independent IGI grading report where specified.
Carat weights and measurements may be subject to normal industry tolerances. Where an individual diamond is independently certified, the applicable grading report records the characteristics of that diamond.
4. Gold & Materials
LØFTE jewellery is crafted in solid gold, including 14k and 18k gold options where specified.
Available metals, finishes and specifications vary by product and are displayed on the applicable product page.
Precious metals naturally develop signs of wear through use. Surface marks, scratches, changes to polish and the development of patina resulting from ordinary wear are not, by themselves, manufacturing defects.
5. Product Availability
Products, diamonds, materials and configurations are subject to availability.
We reserve the right, subject to applicable law, to:

Modify or discontinue products.

Change available diamond, metal or size options.

Limit quantities available for purchase.

Decline or cancel an order where a product, diamond, material or selected configuration is unavailable.
If we are unable to fulfil an order after payment has been received, we will notify you and refund the applicable amount to your original payment method.
6. Made-to-Order Jewellery
Many LØFTE pieces are made to order according to the specifications selected when an order is placed.
Our standard production timeframe for made-to-order jewellery is up to 15 working days, after which your piece will be prepared for dispatch. Shipping time is additional.
Production timeframes are estimates and may occasionally vary due to material availability, quality-control requirements or circumstances outside our reasonable control.
If a material delay affects your order, we will endeavour to notify you.
Because made-to-order jewellery is produced specifically according to the specifications selected by the customer, different cancellation conditions may apply once production has commenced, as described in these Terms and our Returns & Exchanges Policy.
7. Orders
Submitting an order constitutes an offer to purchase the products included in that order.
After checkout, you will receive an order confirmation. Receipt of an automated order confirmation does not necessarily constitute final acceptance of the order.
We reserve the right to decline or cancel an order where reasonably necessary, including because of:

Payment authorisation issues.

Suspected fraud.

Incorrect pricing.

Product, diamond or material unavailability.
-
Incorrect product information.
-
An inability to fulfil the selected configuration.

A breach of these Terms.
If we cancel an order after payment has been successfully processed, the applicable amount will be refunded to the original payment method.
8. Order Changes
Requests to change an order must be made within 24 hours of placing the order.
If you notice an incorrect ring size, metal selection, delivery detail or other order specification, please contact us as soon as possible.
Made-to-order jewellery can enter production quickly. We therefore cannot guarantee that a change will be possible once the 24-hour period has passed or production has commenced.
Customers are responsible for reviewing their selected specifications carefully before completing an order.
9. Cancellations
A made-to-order purchase may be cancelled before production begins.
If you wish to cancel an order, please contact us as soon as possible after purchase.
Once production has commenced, cancellation for change of mind may no longer be possible because the jewellery is being created specifically according to the specifications selected in your order.
Nothing in this section limits any cancellation, refund or other right that cannot lawfully be excluded under applicable consumer law.
10. Ring Sizing
Customers are responsible for selecting the correct ring size when placing an order.
We strongly recommend confirming your ring size with a professional jeweller before ordering, particularly when purchasing a made-to-order piece.
LØFTE does not currently provide an in-house resizing service.
Some rings may be resized by an experienced independent jeweller; however, suitability for resizing depends on the individual design and amount of adjustment required.
Third-party resizing does not automatically void the entire LØFTE Limited Lifetime Manufacturing Warranty. However, damage caused or contributed to by third-party resizing, alteration, repair or servicing is not covered by that warranty.
11. Pricing
Prices are displayed in the applicable store currency unless otherwise stated.
We take reasonable care to ensure that pricing is accurate. However, errors may occasionally occur.
If a product has been incorrectly priced, we reserve the right, to the extent permitted by law, to correct the error before fulfilment.
Where an affected order has already been placed, we may contact you to provide the option to proceed at the correct price or cancel the affected order for a refund.
Prices, promotions and product availability may change without notice.
12. Taxes & Duties
Applicable taxes are calculated or collected where required.
For orders delivered within the United States, applicable sales tax may vary according to the destination state and will be calculated where required.
LØFTE orders delivered to customers in the United States will not require the customer to pay additional import duties upon delivery.
For Australian orders, applicable taxes are handled as part of the purchasing process.
For New Zealand orders, applicable taxes, duties or import charges will be handled or displayed in accordance with the information provided during the purchasing process.
Customers will not be asked to pay import duties that LØFTE has expressly stated are included in the price or collected during checkout.
13. Payments
Payment must be successfully authorised before an order can be processed.
Payments are handled through secure third-party payment providers. LØFTE DESIGNS does not directly store complete payment card details.
Your use of a particular payment method may also be subject to the terms and conditions of the relevant payment provider.
We reserve the right to carry out reasonable fraud-prevention or order-verification procedures before fulfilment.
14. Shipping & Delivery
LØFTE currently delivers to customers in the United States, Australia and New Zealand.
Ready-to-ship jewellery is typically prepared for dispatch within 1–3 business days.
Our standard production timeframe for made-to-order jewellery is up to 15 working days, after which your piece will be prepared for dispatch. Shipping time is additional.
Delivery estimates are provided in good faith but are not guaranteed. Delivery may occasionally be affected by courier delays, weather events, public holidays, peak periods or other circumstances outside our reasonable control.
Where an order cannot be shipped within the timeframe represented to you, we will handle the delay and any applicable cancellation or refund rights in accordance with applicable law.

15. Delivery Security
LØFTE orders are shipped with tracking and insurance while in transit.
A signature is required upon delivery for the security of your jewellery.
Customers are responsible for providing complete and accurate delivery information.
Please review your delivery address carefully before submitting your order and contact us immediately if you discover an error.
16. Returns
Ready-to-ship jewellery may be returned within 30 days of delivery for full store credit, or for a refund to your original payment method less an 8% processing fee, provided it is unworn, undamaged and returned in its original LØFTE packaging with any certification documents included.
Made-to-order, engraved, personalised or otherwise customised jewellery is eligible for exchange or store credit only within 30 days of delivery, and is not eligible for a refund for change of mind.
For hygiene reasons, earrings may be exchanged or issued store credit within 30 days of delivery if returned unworn in their original packaging, but are not eligible for a refund for change of mind.
Return shipping for a change-of-mind return is the customer's responsibility. Please contact us before returning any jewellery.
This policy does not exclude or limit any rights or remedies available to you under applicable consumer law, including where jewellery is faulty, damaged, incorrectly supplied or otherwise does not comply with applicable consumer guarantees.

17. Exchanges
Eligible pieces may be exchanged or returned for store credit within 30 days of delivery, subject to the conditions set out in our Returns & Exchanges Policy.
Pieces must be unworn, undamaged and returned in their original LØFTE packaging. Please contact us before returning any jewellery.
Nothing in this policy limits any rights or remedies that cannot lawfully be excluded under applicable consumer law.
18. Damaged, Faulty or Incorrect Orders
Every LØFTE piece is carefully inspected before dispatch.
If your jewellery arrives damaged, defective or different from what you ordered, please contact us as soon as possible after delivery.
Please provide:

Your order number.

A description of the issue.

Clear photographs or video of the jewellery.

Photographs of the packaging where transit damage is suspected.
Please retain the jewellery and original packaging while the matter is being assessed.
Where necessary, the piece may be returned for professional inspection.
Where a manufacturing fault or other covered issue is confirmed, LØFTE will provide an appropriate remedy, which may include repair, replacement or refund depending on the circumstances and applicable law.
19. Limited Lifetime Manufacturing Warranty
LØFTE jewellery is backed by our Limited Lifetime Manufacturing Warranty, subject to the complete terms, conditions and exclusions contained in that warranty.
The warranty covers eligible structural, stone-setting and other defects in materials or workmanship determined to have resulted from manufacture.
It does not cover normal wear and tear, scratches or ordinary changes to the finish of precious metals, accidental damage, loss, theft, improper care, misuse or damage caused by circumstances unrelated to manufacture.
Third-party resizing, repairs, servicing or alterations do not automatically void the entire warranty. However, damage caused or contributed to by third-party work is not covered.
Stone loss is not automatically covered. Where a stone becomes loose or is lost, the cause may be professionally assessed. Where the issue is determined to have resulted from a manufacturing defect, it will be treated in accordance with the Limited Lifetime Manufacturing Warranty.

20. Australian Customers — Australian Consumer Law
If you are a consumer in Australia, your purchase is protected by consumer guarantees under the Australian Consumer Law.
Nothing in these Terms, our Returns & Exchanges Policy, Shipping & Delivery Policy or Limited Lifetime Manufacturing Warranty excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
Where goods fail to satisfy an applicable consumer guarantee, you may be entitled to a repair, replacement, refund, compensation or other remedy in accordance with the Australian Consumer Law.
Our Limited Lifetime Manufacturing Warranty is provided in addition to your rights and remedies under the Australian Consumer Law.
Where required in connection with our Limited Lifetime Manufacturing Warranty, the following statutory notice applies:
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms imposes a shorter time limit on rights that you are entitled to exercise under the Australian Consumer Law.
21. United States Customers
For customers in the United States, these Terms and our Limited Lifetime Manufacturing Warranty operate subject to applicable federal and state consumer-protection and warranty laws.
Nothing in these Terms is intended to disclaim, exclude or restrict any implied warranty, statutory right or consumer remedy where doing so is prohibited by applicable law.
Certain states may provide additional warranty or consumer rights. Your rights may therefore vary depending on the state in which you reside.

22. New Zealand Customers
For customers in New Zealand, these Terms and our Limited Lifetime Manufacturing Warranty operate subject to applicable New Zealand consumer-protection laws, including any rights that cannot lawfully be excluded or limited.
Nothing in these Terms, our Returns & Exchanges Policy, Shipping & Delivery Policy or Limited Lifetime Manufacturing Warranty excludes, restricts or modifies any consumer guarantee, statutory right or remedy that cannot lawfully be excluded, restricted or modified.
Depending on the circumstances, customers may be entitled to a repair, replacement, refund, compensation or another remedy where goods fail to comply with an applicable consumer guarantee.
Our Limited Lifetime Manufacturing Warranty is provided in addition to any rights or remedies available under applicable New Zealand law.
23. Intellectual Property
Unless otherwise stated, all content on the LØFTE DESIGNS website—including our name, branding, logos, product designs, text, graphics, photographs, videos, artwork, layouts and other creative material—is owned by or licensed to LØFTE DESIGNS and is protected by applicable intellectual property laws.
You may access our content for personal, non-commercial use.
You may not reproduce, copy, modify, distribute, publish, sell, commercially exploit or create derivative works from our content without prior written permission, except where permitted by law.
Nothing in these Terms transfers ownership of any LØFTE intellectual property to you.
24. Third-Party Services
Our website may use or provide access to third-party services, including payment providers, shipping carriers and technology platforms.
Those services may be governed by their own terms and privacy policies.
To the extent permitted by law, LØFTE is not responsible for the independent acts or omissions of third-party providers outside our reasonable control.
Nothing in this section limits responsibility that cannot lawfully be excluded.
25. Limitation of Liability
To the maximum extent permitted by applicable law, LØFTE DESIGNS will not be liable for indirect, incidental, special or consequential loss arising from use of our website, products or services where such liability may lawfully be excluded.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, implied warranty, statutory right or remedy that cannot lawfully be excluded, restricted or modified.
Where our liability may lawfully be limited, it will be limited only to the extent permitted by applicable law.
26. Consumer Rights
These Terms and all LØFTE policies are intended to operate alongside applicable consumer-protection laws.
Nothing in our Terms, policies or warranty is intended to remove a statutory right or remedy that cannot legally be excluded.
Where these Terms conflict with a mandatory requirement of applicable law, the mandatory legal requirement will prevail.
27. Privacy
Our Privacy Policy explains how we collect, use, disclose, store and protect personal information when you use our website or purchase from LØFTE DESIGNS.
Your use of the website is subject to our Privacy Policy and applicable privacy laws.
28. Changes to These Terms
We may update these Terms from time to time to reflect changes to our products, services, business practices or legal obligations.
The current version will be published on this page together with its effective or last-updated date.
Changes will apply from the date the updated Terms are published and will not retrospectively alter rights or obligations relating to completed transactions except where permitted or required by law.
29. Governing Law
These Terms are governed by the laws of Queensland, Australia, subject always to mandatory consumer protections that apply to your transaction.
For Australian consumers, nothing in this provision excludes or restricts rights under the Australian Consumer Law.
For United States and New Zealand consumers, nothing in this provision is intended to deprive you of mandatory consumer rights or protections available under the laws applicable to your transaction.
30. Severability
If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to make it enforceable where permitted.
If that is not possible, the affected provision will be severed without affecting the validity or enforceability of the remaining provisions.
31. Entire Agreement
These Terms, together with the policies expressly incorporated or referenced within them, constitute the terms governing your use of the LØFTE website and purchases from us, subject to any rights or obligations that cannot lawfully be excluded.
